1. Acceptance of Terms
By accessing or using Who's In ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
Who's In is an event coordination platform that helps organizers manage RSVPs, waitlists, and notifications for small-scale events such as yoga classes, fitness sessions, hikes, book clubs, and casual meetups. The Service includes web and mobile applications, WhatsApp integrations, and related features.
3. User Accounts
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
4. User Conduct
You agree not to:
- Create events for illegal activities
- Harass, abuse, or harm other users
- Post false, misleading, or deceptive content
- Spam or send unsolicited messages
- Attempt to gain unauthorized access to the Service
- Use the Service for commercial solicitation without permission
- Violate any applicable laws or regulations
5. Event Organizer Responsibilities
If you create events on the platform, you are responsible for:
- Providing accurate event information
- Ensuring your events comply with local laws and regulations
- Obtaining any necessary permits or permissions
- Managing attendee communications appropriately
- Managing attendee payments and fees in accordance with applicable laws and platform policies
7. Disclaimer of Liability
Who's In is a platform for event coordination only. We do not organize, host, or participate in any events listed on the platform. We are not responsible for:
- The quality, safety, or legality of events
- Actions or omissions of event organizers or attendees
- Any injuries, damages, or losses occurring at events
- Disputes between organizers and attendees
- Event cancellations or changes
Participation in any event is at your own risk. We recommend reviewing event details carefully and using appropriate judgment.
8. Intellectual Property
The Service, including its design, features, and content, is owned by Who's In and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.
You retain ownership of content you create (event descriptions, messages). By posting content, you grant us a license to display and distribute it as necessary to provide the Service.
No Advertising Promise
Who's In will never display third-party advertisements to organizers or attendees. We are funded through a small fee on paid ticket sales. Your event pages, RSVP forms, and dashboards will always be ad-free. This is a core commitment, not a temporary policy.
Paid Subscriptions, Billing & Cancellation
Certain products (Studio, Clubs, Conference) require a paid monthly or annual subscription. Payment is processed via Stripe. A valid credit or debit card is required to activate your subscription.
Billing cycle: Subscriptions renew automatically at the start of each billing period (monthly or annually). You will be charged the applicable rate at the beginning of each renewal period.
Cancellation: You may cancel your subscription at any time from your account settings or member portal. Cancellation takes effect at the end of your current billing period. You will retain access to all paid features until the end of that period.
No pro-rata refunds: If you cancel mid-cycle, you will not receive a partial refund for the remaining days in your current billing period. Your access continues until the period ends.
Studio member cancellation notice: Individual studios may set a cancellation notice period (e.g., 30 days). If a studio has configured a notice period, your cancellation will take effect after the notice period expires, and you will continue to be billed until that date. The notice period applicable to you is the one in effect at the time you joined the studio.
Refunds: Studio owners may issue full or partial refunds for membership payments and class bookings at their discretion. Platform subscription refunds are handled on a case-by-case basis by contacting support.
9. Service Availability
We strive to maintain reliable service but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features at any time. We are not liable for any downtime or service interruptions.
10. Account Termination
You may delete your account at any time. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your access to the Service will cease, and we may delete your data in accordance with our Privacy Policy.
11. Limitation of Liability
To the maximum extent permitted by law, our total liability is capped at the fees you have paid to Who's In in the last 12 months. We are not liable for any indirect, consequential, special, incidental, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, business opportunities, or goodwill.
12. Indemnification
You agree to indemnify and hold harmless Who's In and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
13. Changes to Terms
We may modify these Terms at any time. Significant changes will be communicated via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the new Terms.
14. Governing Law
These Terms are governed by the laws of the United Arab Emirates. Any disputes shall be resolved in the courts of Dubai, UAE.
